Motion is Emotion: Footage Submission Terms
These terms apply when you send footage to edelkrone through the form on the Motion is Emotion page. By ticking the box and sending the form, you agree to them.
1. What Motion is Emotion is
Motion is Emotion is edelkrone's video compilation series. Each episode is made from shots captured by edelkrone users, edited by edelkrone's production team to its own music, and published on edelkrone's YouTube channel, website and social media, with the creators named as Featured Artists.
2. Who can send footage
- You must be at least 18 years old, or the age of majority where you live if that is higher.
- You must own the footage, or be authorized by its owner to send it on these terms. A company or studio may send footage through one authorized person.
3. What you send
You send a link to your video (for example YouTube, Vimeo or a download link). Your footage should be captured at least in part with edelkrone equipment. It must not contain anything illegal, harmful, defamatory, hateful or sexually explicit, or anything that infringes anyone's rights.
4. Selection
edelkrone's production team decides which shots, if any, are used, and in which episode. Sending footage does not mean it will be used, and edelkrone may not reply to every submission. If your shots are picked, edelkrone may contact you, for example to confirm your credit or to ask for a higher-quality file.
5. Your rights and the rights you give edelkrone
Your footage stays yours. You keep ownership of your footage, and you can keep using it however you like. Sending it does not transfer any ownership to edelkrone.
The license. By sending footage, you grant edelkrone a non-exclusive, perpetual, worldwide, royalty-free, transferable, sublicensable and irrevocable license to use, reproduce, edit, modify, distribute, display, publicly perform and create derivative works from your footage, in whole or in part, in Motion is Emotion episodes and in material that promotes the series and edelkrone, in any medium now known or later developed. This includes publishing episodes on edelkrone's YouTube channel, websites, social media accounts, emails and product pages, using episodes in advertising, and the right to cut, trim, reframe, color grade, change the speed of and combine your shots with other footage, to remove or replace their audio, and to add titles, graphics and credits.
The license continues for episodes already published, even if you later delete your original video. You waive any claim to royalties or other compensation for these uses, and, to the extent the law allows, any moral rights in the footage as it is used in the episodes.
Changing your mind. Until your shots are used in an episode, you can withdraw your submission by contacting us, and edelkrone will not use it.
Music. Episodes use their own music. The audio of your footage, including any music in it, is not used.
6. Credit
If your shots are used, edelkrone credits you with the "Name to credit" you entered, in the episode's Featured Artists on the Motion is Emotion page and in the video description. edelkrone may shorten or adjust a credit to fit, and may correct it at your request.
7. No payment
Motion is Emotion is a showcase. edelkrone does not pay for footage sent through this form, whether or not it is used.
8. Your promises
You confirm that the footage is your own work or that you are authorized to send it, that you have all rights and permissions needed for the uses above, including from anyone who appears in the footage and the owners of any locations, artworks or other material shown in it, and that the footage does not infringe anyone's rights. To the extent the law allows, you agree to cover claims by third parties that arise from footage you send, including claims that it infringes their rights.
9. Your information
edelkrone uses the details you send (your name, email, country, credit name, video link and gear) to review your footage, contact you about it and credit you. Sending the form does not sign you up for edelkrone's newsletter. Your information is handled as described in the edelkrone Privacy Policy.
10. Changes and governing law
edelkrone may change these terms by publishing an updated version on this page. The version you agreed to is saved with your submission and applies to the footage you sent with it. These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. If a provision of these terms is found unenforceable, the rest stays in effect. Nothing in these terms limits liability that cannot be limited by law.
